The arbitrator's decision shall be binding on all parties. The arbitrator shall not amend or modify any of the provisions of this Agreement. The arbitrator's authority shall be strictly limited to deciding the issue or issues presented to him or her in writing.

Association Dues Deduction — Bi-monthly from each member's pay
Upon receipt of a dues deduction authorization executed by the individual Employee, the Board shall deduct bi-monthly from each member's pay the current dues of the Association. Authorization for new members must be executed on or before October 1st.

Association Leave Days — up to a total of eight (8) days per year as Association Leave
The Board shall grant to the Rochester Education Association Co-Presidents or his/her designee, up to a total of eight (8) days per year as Association Leave to attend state, national, regional conventions or local grievance proceedings. The Association shall give at least seventy-two (72) hours notice of such leave and shall pay for the cost of a substitute employed on such day.

Employees shall be reimbursed per credit hour for tuition and fees earned in an approved advanced degree program a maximum of $2,350 or the actual cost of tuition and fees, whichever is less, for a grade of 'A or B'.

The teacher work day shall be seven (7) hours and thirty (30) minutes which includes supervision as assigned by the Principal or Superintendent.

Evaluation Notice Timeline — Within two (2) weeks after the beginning of each school year, building Principal or immediate supervisor shall inform each Employee under his/her supervision of the evaluation procedures, standards, and instruments to be used.

Upon written request, the employer shall grant up to twelve (12) work weeks of unpaid leave in accordance with the District's Family Medical Leave policy and as governed by the Family Medical Leave Act of 1993. Family Medical Leave shall run concurrent with all other paid or unpaid leave available to the Employee, without loss of tenure or seniority.

Transfer Procedures — A transfer is when the Board reassigns an Employee from one building to another building where the Employee was not previously assigned. Exceptions include reassignments between Early Childhood through Grade 3 buildings. Transfers based upon certification and seniority with least senior Employee being transferred.
